As many will know, the House of Lords convened a Select Committee to consider the Bill, which heard from witnesses in late October / early November. It has now finished its evidence sessions. The transcripts of the oral evidence given by witnesses can be found here; their written evidence can be found here. My oral evidence to the Committee can be found here, (note, this is the uncorrected transcript; a corrected transcript will be up in the next few days). My written evidence explaining why I consider the Bill does not meet the Cabinet Office guidance test for ‘good law’ is here. A supplementary note can be found here, addressing judicial review as a route of challenge to Panel decisions and fluctuating capacity). The oral evidence of my Complex Life and Death Decisions group colleague Professor Katherine Sleeman can be found here., and her written evidence here (with a supplementary note here).
The Committee is due to report ahead of first day of Committee stage in the House of Lords, which starts on 14 November 2025.
My resources page on the Bill can be found here. I will try to keep it up-to-date, but as I am trying to assist here amongst several other day jobs, I hope I will be forgiven if it is not done on a rolling basis.
