Alex RKThe GMC is consulting on a replacement to its current Confidentiality guidance, published in 2009. The guidance addresses, inter alia, the position in relation to those lacking capacity to consent to disclosure. I would very much urge anyone with a passing interest in ensuring that these difficult issues (both ethically and legally) are addressed properly to respond.
